Brain Love Bundle Competition (New Zealand and Australia) – Terms & Conditions

The Promoter. The promoter is Alphagen NZ Limited, trading as ĀREPA, 30 Hannigan Drive, Mount Wellington, Auckland 1072, New Zealand (Promoter). By entering, you agree to these terms and conditions.
Who can enter. This is a single competition run across New Zealand and Australia. Entry is open to residents of New Zealand and residents of Australia (excluding residents of the Australian Capital Territory) aged 18 years or over. Employees of the Promoter and its agencies, and their immediate families, are not eligible. Winners may need to provide proof of identity, age and residency before receiving a prize.
Competition period. The competition opens at 8:00am NZT on Thursday 8 October 2026 for New Zealand entrants and at 10:30am AEDT on Friday 9 October 2026 for Australian entrants. It closes for everyone at 11:59pm NZT on Saturday 31 October 2026 (9:59pm AEDT) (Competition Period). Eligible purchases must be made during the Competition Period.
Two draws. There are two separate draws, each with one prize: the Online Draw and the In-Store Draw. Entrants from New Zealand and Australia go into the same two draws. Entries earned under clause 5(a) count in both draws. Entries earned under clause 5(b) count in the Online Draw only. Entries earned under clause 5(c) count in the In-Store Draw only.
How to enter. There are three ways to earn entries:
1. Email sign-up: 10 entries in each draw. Sign up to ĀREPA marketing emails during the Competition Period, at drinkarepa.com or drinkarepa.com.au, to receive 10 entries in the Online Draw and 10 entries in the In-Store Draw. If you are already subscribed to ĀREPA marketing emails in New Zealand or Australia and are still subscribed at the close of the Competition Period, you automatically receive these entries. A maximum of 10 email entries per draw applies per person, regardless of the number of email addresses used.
2. Online purchases: 1 entry for every $1 spent. Purchase any ĀREPA product at drinkarepa.com (in NZ$) or drinkarepa.com.au (in A$) during the Competition Period to receive 1 entry in the Online Draw for every whole dollar spent in the currency of the store you purchased from. Spend is calculated on the order total after discounts, including GST and excluding shipping, rounded down to the nearest dollar. Subscription orders processed during the Competition Period are included. Cancelled, refunded or returned orders are excluded.
3. In-store purchases: 3 entries for every $1 spent. New Zealand entrants: purchase ĀREPA Brain & Gut Soda from any New Zealand retailer and upload a photo of your receipt at drinkarepa.com/pages/brain-love. Australian entrants: purchase any ĀREPA drink from any Australian retailer and upload a photo of your receipt at drinkarepa.com.au/pages/brain-love. You receive 3 entries in the In-Store Draw for every whole dollar spent on the eligible ĀREPA products, in the currency of the receipt (NZ$ or A$). Receipts must be uploaded by 11:59pm NZT on Monday 2 November 2026 (9:59pm AEDT). The receipt must clearly show the retailer, the purchase date and the eligible ĀREPA purchase and price. Only the amount spent on eligible ĀREPA products counts. Each receipt can only be submitted once. The Promoter may ask to see the original receipt, so please keep it until the winners are announced.
No purchase necessary. You do not need to buy anything to enter. Entry by email sign-up is free.
The prizes. There are two (2) prizes: one for the winner of the Online Draw and one for the winner of the In-Store Draw. Each prize is one Brain Love Bundle, made up of:
- 1 x Oura Ring 4 (valued at up to NZ$999, approx. A$900; size and finish subject to availability; any Oura membership fees after the included trial period are the winner’s responsibility);
- a 12-month supply of The Brain Capsules for Sleep Support (12 x 60-capsule bottles, RRP NZ$780); and
- 3 x 12-packs of The Brain & Gut Soda, one of each flavour: Raspberry Lemonade, Lemon Lime and Pineapple Ginger (RRP NZ$180, approx. A$160).
Each Brain Love Bundle has a total retail value of over NZ$1,900 (up to approx. NZ$1,959, approx. A$1,750). The total prize pool is valued at up to approximately NZ$3,918 (approx. A$3,500). Australian dollar values are approximate conversions.
Winner selection. Both draws will take place at the Promoter’s office in Auckland at 11:00am NZT on Wednesday 4 November 2026. The Online Draw will be conducted first, followed by the In-Store Draw. In each draw, one winner will be drawn at random from all valid entries in that draw, and each entry has an equal chance of being drawn. Each person can win only one prize. If the Online Draw winner is also drawn in the In-Store Draw, the In-Store Draw will be redrawn.
Winner notification. The winners will be contacted by email within two (2) business days of the draw, and announced by 8 November 2026. If a winner cannot be contacted, or does not claim their prize within fourteen (14) days of notification, the Promoter may redraw that prize from the remaining valid entries.
Prize conditions. Prizes will be delivered free of charge to an address in New Zealand or Australia, and may be shipped from New Zealand. Prizes are not transferable and cannot be exchanged or redeemed for cash. If a prize item becomes unavailable for reasons outside the Promoter’s control, the Promoter may substitute an item of equal or greater value. The Oura Ring is covered by the manufacturer’s warranty. The Promoter is not responsible for any warranty claims.
Invalid entries. The Promoter may disqualify any entry or entrant it reasonably believes has tampered with the entry process, submitted altered, duplicated or fraudulent receipts, used automated means to enter, or otherwise breached these terms.
Privacy. Personal information collected in this competition will be held by the Promoter in accordance with the Privacy Act 2020 (NZ) and, for Australian entrants, the Privacy Act 1988 (Cth). It will be used to run the competition, contact and deliver prizes to the winners and, where you have subscribed, to send you ĀREPA marketing emails (you can unsubscribe at any time). You can access or correct your personal information by emailing help@drinkarepa.com.
Publicity. The Promoter may publish each winner’s first name and town or city on its website, emails and social media channels.
Liability. To the extent permitted by law, the Promoter is not liable for any loss, damage or injury arising from the competition or any prize. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 (New Zealand), or the Australian Consumer Law.
Changes. If the competition cannot run as planned for reasons beyond the Promoter’s control, the Promoter may change, suspend or cancel it, subject to any applicable law.
No third-party association. This competition is not sponsored, endorsed or administered by, or associated with, Oura, Instagram, Facebook or Meta.
Governing law. These terms are governed by the laws of New Zealand. Australian entrants also have the benefit of any rights that cannot be excluded under Australian law.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Credit card information is always encrypted during transfer over networks.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Section 6 – Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

Welcome to Alphagen NZ Limited. These Terms of Service ("Terms") govern your subscription with us. By subscribing, you agree to comply with these Terms. Please read them carefully

Legacy Pricing Exclusions

Subscribers on legacy pricing plans (i.e., subscription plans that feature a lower rate than the current retail price, even after discounts) are not eligible for the following benefits:

Additional discounts, promotions, or offers, including but not limited to seasonal sales or promotional codes.
Free shipping, unless otherwise explicitly stated in your subscription agreement.

Legacy pricing ensures continued access to a lower subscription rate compared to our standard pricing, but additional perks may be reserved for subscribers on current pricing plans.

Subscription Modifications

If you choose to upgrade or modify your subscription to a current pricing plan, you may become eligible for additional discounts, offers, or free shipping as specified at the time of the upgrade.
Downgrading to legacy pricing from a current pricing plan is not permitted.

Payment Terms

All payments are processed in accordance with the subscription terms provided at sign-up.
Subscribers on legacy pricing will continue to be billed at the legacy rate unless they cancel their subscription or upgrade to a current pricing plan.

Shipping Policy

Free shipping, where offered, applies only to subscribers on current pricing plans unless otherwise specified.
Shipping rates for legacy pricing subscribers are calculated based on the standard rates applicable at the time of shipping.

Changes to Terms

Alphagen NZ Limited reserves the right to update or modify these Terms at any time. Any changes will be communicated to subscribers via email or through our website.
Continued use of the subscription after such changes constitutes acceptance of the revised Terms.

Section 23 – Terms and Conditions for Sale Offers

Eligibility: Any Sale offer is available only on select products as listed on our website or promotional materials. Subscriptions are excluded from offers.
Stock Availability: The offer is valid while stocks last. No rain checks or backorders will be provided for out-of-stock items.
Promotional Period: The offer is valid only during the specified promotional period. Once the promotion ends, regular pricing applies.
Exclusions: This offer cannot be combined with any other discounts, promotions, or offers unless explicitly stated. Subscriptions and certain other items may be excluded.
Purchase Conditions: All sales made under this promotion are subject to our standard terms and conditions of sale, including return and exchange policies.
Price Adjustments: Prices and discounts applied during this offer are final. No price adjustments will be provided for purchases made before or after the promotional period.
Amendments: The company reserves the right to modify, suspend, or terminate the offer at any time without prior notice.
Legal Compliance: This promotion is void where prohibited by law.
